Non-conformity of goods
Statutory provisions (ZVPot-1)
I. Conformity requirements
Article 71 (seller liability)
The seller delivers goods that meet statutory requirements and is liable for any non-conformity present at delivery.
Article 72 (subjective requirements)
Goods conform to the sales contract in particular when they:
- match the description, type, quantity and quality required by the contract;
- are fit for the specific purpose communicated by the consumer and accepted by the seller;
- are supplied with accessories and instructions as required by the contract;
- are updated as required by the contract.
Article 73 (objective requirements)
In addition to Article 72, goods must also:
- be fit for the purposes for which goods of the same type are normally used;
- match any sample or model made available before the contract, where applicable;
- be supplied with expected accessories, packaging and instructions, where applicable;
- have the quantity and characteristics normally expected, including durability and safety.
unless the seller proves that:
- the seller did not know and could not reasonably have known of the public statement,
- the statement was corrected before the contract, or
- the statement could not have influenced the purchase decision.
Article 74 (digital elements)
(1) For goods with digital elements, the seller ensures that updates (including security updates) are provided for the required period.
- for the period the consumer may reasonably expect for one-off supply, or
- two years for continuous supply for a specific period, or
- the period agreed for continuous supply longer than two years.
(2) If the consumer does not install updates within a reasonable time, the seller is not liable provided the consumer was informed and instructions were adequate.
- the seller informed the consumer about the update and consequences, and
- the failure was not due to missing or inadequate installation instructions.
Article 75 (exemption)
The seller is not liable for objective non-conformity if the consumer was specifically informed and expressly accepted the deviation at contract conclusion.
Article 76 (installation)
(1) If installation is part of the contract and performed by the seller, any non-conformity due to incorrect installation is treated as non-conformity of the goods.
(2) If the consumer installs the goods and incorrect installation is due to deficient instructions, any non-conformity is treated as non-conformity of the goods.
Article 77 (third-party rights)
If third-party rights (including IP rights) prevent or limit use, the consumer is entitled to remedies for non-conformity under this chapter.
II. Time limits and prohibition of limitation
Article 78 (time limits)
(1) The seller is liable for any non-conformity that appears within two years from delivery.
(2) This also applies to goods with digital elements without prejudice to Article 74(1).
(3) For continuous supply of digital content/services, liability applies for non-conformity within two years from delivery.
(4) For continuous supply longer than two years, liability applies throughout the agreed supply period.
(5) For second-hand goods, the parties may agree on a shorter period, but not less than one year.
Article 79 (prohibition)
(1) Contract terms cannot limit or exclude seller liability as defined by law.
(2) Any term contrary to the above is void.
III. Burden of proof
Article 80 (general)
(1) Non-conformity is presumed to have existed at delivery if it appears within one year, unless proven otherwise or incompatible with the nature of goods/non-conformity.
(2) For goods with digital elements and continuous supply, the seller bears the burden of proof for conformity during the relevant period.
IV. Remedies
Article 81 (remedies)
(1) In case of non-conformity, the consumer may:
- request free restoration of conformity;
- request a proportional price reduction or withdraw and request a refund.
(2) The consumer may withhold payment until the seller fulfils obligations, by notifying the seller.
(3) The consumer may also claim damages and related costs arising from exercising remedies.
Article 82 (restoration of conformity)
(1) The seller must restore conformity within a reasonable time not exceeding 30 days, free of charge and without significant inconvenience.
(2) The period may be extended up to 15 days if needed for repair/replacement, considering complexity and severity. The seller informs the consumer about the extension and reasons before the deadline.
(3) Conformity is restored free of charge when the seller also covers necessary costs, especially shipping, transport, labor, or materials.
(4) The consumer may choose between repair and replacement, unless:
- fulfilment of the chosen remedy is impossible, or
- it would impose disproportionate costs on the seller compared to the other remedy, considering all circumstances.
(5) Relevant circumstances include in particular the value the goods would have if conforming, the significance of the non-conformity, and whether the other remedy can be provided without significant inconvenience.
(6) The seller may refuse restoration of conformity if repair and replacement are impossible or would cause disproportionate costs, considering all circumstances.
(7) Where repair or replacement is required, the consumer makes the goods available to the seller. Where replacement is required, the seller takes back the replaced goods at its own expense.
(8) If goods installed according to their nature and purpose must be removed for repair or replacement, the obligation includes removal of the non-conforming goods and installation of replacement or repaired goods, or covering the costs of removal and re-installation.
(9) The consumer does not pay for normal use of replacement goods in the period before replacement.
Article 83 (price reduction and withdrawal)
(1) The consumer may request a proportional price reduction or withdraw in any of the following cases:
- the seller did not repair or replace, did not complete the repair/replacement in accordance with the law, or refused restoration under Article 82(6);
- non-conformity exists despite the seller attempting to restore conformity;
- the non-conformity is so serious that it justifies immediate price reduction or withdrawal; or
- the seller stated or it is clear from circumstances that conformity will not be restored within a reasonable time or without significant inconvenience.
(2) Regardless of the above, the consumer may withdraw and request a refund if the non-conformity appears within 30 days of delivery.
(3) A proportional price reduction is proportional to the decrease in value of the goods received compared to conforming goods.
(4) Withdrawal is exercised by a statement notifying the seller of the decision to withdraw.
(5) If the non-conformity concerns only part of the goods and withdrawal is justified, the consumer may withdraw also for any other goods obtained together, if it is unreasonable to keep only the conforming goods.
(6) If the consumer withdraws, the consumer returns the goods at the seller’s expense.
(7) The consumer cannot withdraw if the non-conformity is minor. The seller bears the burden of proof that it is minor.
Article 84 (notice and inspection)
(1) The consumer may exercise rights if the seller is notified within two months of discovering the non-conformity.
(2) The notice describes the non-conformity in detail.
(3) Notice can be given in person (with confirmation), sent to the shop where purchased, or given to the seller’s representative.
(4) The consumer allows the seller to inspect the goods claimed to be non-conforming.
Article 85 (existence of non-conformity)
If the existence of non-conformity is disputed, the seller informs the consumer in writing within eight days of receiving the consumer’s claim.
Article 86 (refund deadline)
(1) If the consumer withdraws, the seller refunds without delay, no later than eight days after receiving the goods or proof of return shipment.
(2) If the consumer requests a proportional price reduction under Article 83(3), the seller refunds the relevant part within eight days of receiving the request.
Article 87 (loss of rights)
Rights under Article 81(1) expire two years from the day the consumer notified the seller of the non-conformity.

Return of goods — right of withdrawal — refund
Under consumer protection law the buyer may notify the seller within 14 days of receiving the goods that they withdraw from the contract, without giving a reason. The buyer can download the withdrawal form or send any unambiguous statement via www.amo-pure-energy.com
In this case, the provider immediately sends the buyer an email confirmation of receipt of the withdrawal on a durable medium.
The only cost borne by the buyer is the cost of returning the goods. Goods must be returned no later than 14 days after sending the withdrawal notice.
The buyer is deemed to have returned the goods in time if they are sent before the end of the 14-day return period.
Returned goods must be undamaged and in unchanged quantity, unless destroyed, damaged, lost, or diminished without the buyer’s fault.
Refunds are made without delay and no later than 14 days after receipt of withdrawal notice. Refunds are made using the same payment method unless another method is expressly requested and causes no costs to the buyer.
The provider may withhold the refund until receipt of returned goods or proof that the buyer has sent them back.
Returning the goods within the withdrawal period is considered a notice of withdrawal.
The consumer must not use the product freely until withdrawal, but may inspect and test it only to the extent necessary to establish its condition as is usual in stores.
Any testing beyond this can be considered use, meaning the consumer loses the right of withdrawal. The returned item must be unused, undamaged and in original packaging. A copy of the invoice or other appropriate document must be attached.
The buyer cannot withdraw from the contract in the following cases:
- the buyer ordered a made-to-order item,
- jewelry or any item that is personalized — ordered to the buyer’s specifications.
Information on the absence of the right of withdrawal, where exceptions are listed in accordance with Article 135 of the law, or, where appropriate, on circumstances in which the consumer loses the right of withdrawal.
